Can i break lease cuase noise?

My upstairs niaghbors party 24/7 and I have three roommates and one has a dog that woke me at 2am yesterday and 2 of them been playing music in the middle of the night. I have a job that starts at 5AM. Is there any legal recourse to get out of lease?

    Call the police and complain about the noise (most towns, cities, and even counties have some kind of noise laws for late night).

    Keep doing it. Over and over again.

    Talk to the police (or city) and ask them to notify the landlord about the reoccurring problem at their property (most places require them to evict the tenants causing the problem - and cannot do anything to the person reporting the problem).

    If the police (or city) will not do that, then after a series of documented noise complaints ask the landlord to eliminate the documented problem from their property.

    If they refuse to do that... then you may have a legal reason to break the lease (as the landlord is not meeting their legal obligations). In the USA (and many countries - but not all) there are legal requirements that a landlord must deal with problem tenants. You need to run this by someone who knows the local and state rental laws.

    Most cities have some kind of rental issue group that can advise you of the basics without you having to hire a lawyer. Some will step in and take action for you. Do a web search for "renter issues" combined with your state or countries name. They should pop up. I have used one in a city over 150 miles away as they could advise me on the State Statutes involved and what to tell the landlord.

    If you hire a lawyer - be sure to get one that is familiar with the appropriate laws and has done similar renter vs landlord claims before.

    There's a possibility if you tell the landlord all this, they might let you go. Though it really depends on the terms of your lease.

    I'd speak to an attorney in your local area. You could possibly use the defense that others are breaking the lease terms (Breach of Lease) by being too noisy. Read your lease...sometimes it will say when it can be broken and if there are any rules regarding quiet times or partying.

    • I tried this before and landlord said "Well you can break the lease If you find someone take over your lease. Otherwise deal with it". As well as a fee of 300 dollars.

        • No, that's not how this works. I have 8 months of lease and 600$. I guessing you never rented before and this is a new concept for you. I would still have to pay the rest of rent. It's a contract. So I'll ow 4800. 300$ is to break the lease and move on. If I just leave I still ow the 4800.
