Can i sue my school for this?

I really want to sue my school district for emotional damages when I turn 18. I recently had a traumatic experience due to a guidance counselor who works there, and I was recently diagnosed with PTSD and a couple other disorders because of it. Would I have legal grounds to sue for damages here? I want payback. Is it normal to feel this?

    I was assaulted by a vice principal in my senior year. He grabbed my arm so hard I had a bruise, threw me in a corner and screamed in my face. When my brother tried to defend me, he threatened him with violence. Granted, I was swearing but he took it too far as I'm a 95 pound girl. My mom called the cops and they didnt do anything. Oh and I was suspended. When I got back I had a meeting with the school cop who also told me I couldn't do anything unless I wanted to face charges as well... for swearing. I was swearing because the above mentioned vice principal made us stand outside in the pouring rain for half an hour to wait for a bus.

    I recently sued a high school teacher of mine for what the Education Dept. called "Intentional Severe Mental Abuse", which is a criminal offence.
    My experience is tricky though.

    But don't sue with grounds for pay back. Do it for recognition that these things do happen in schools and people need to be aware so it doesn't happen again.
    Though people who do this need to be punished for what they did.
    My teacher nearly got fired but I guess she was too well liked and respected, but she got a criminal record, fined and demoted with supervised classes.

    What would suing them do? Make you another statistic? Another obnoixous victim who wants to make the entire school system pay for something one person did to you? You would literally be taking money from your own community. But maybe it's a private school.

    Did the guidance counselor give you PTSD personally. Or did they not do their job properly. You do no you will have to be subjected to another psychological evaluation to determine PTSD.

    Without any details of the incident that upset you my assumption automatically goes to the fact that many people are way to eager to sue for their own negligence or hold the wrong people accountable for the emotional trauma you experienced.

    I could be way off, but most people who throw the word "sue" into a situation are usually full of shit. Maybe you are the exception. I have no way of knowing at this point in time.

    .... How are we suppose to help if you don't explain better than that.. But I hope your parents got extra dough because lawyers get expensive and if u don't have a good case and lose then your out a lot of money

    How old are you now? If you are a few years shy from 18 then you would be better off telling your parents and suing now instead of waiting in torment for all of that time.

    I seriously doubt you could have PTSD from what some freaking guidance counselor did. Do you think you're the only high school student who has ever felt "traumatized" by what some teacher, guidance counselor or coach said or did? That's part of growing up, which is something YOU need to do. When you've served in the military in a place like Iraq or Afghanistan, then you can complain about PTSD, but until then, you don't know the meaning of the word! Stop whining and GROW UP!

    I dont think so . you might be able to but schools rarely ever care they will write you off as a maniac who needs to be locked up before they even let you get to court becuase they are so big and have more money than you they will say " They need to be locked up " or they will huminliate you infront of the poeple attending the campus . To put it short schools are krap they dont care what you went through and they will destroy you and your reputation not to pay for anything they have done even if negligience has cuased a childs death . However if you ever sue a school for compusation I think the best option will be to destory the school and get it were they must be shut down .

    Woah, woah, woah, slow down. Considering you would win in the district court is a chance of 50-50. the school has lawyers that are most likely fresh from law school and payed monthly to support them in the court of justice should you or anyone else decide to sue. You could pay for a seasoned lawyer but most of them will forget some of the things they learned in school. You could try still.

    Listen, YOU have the burden of proof here. You need to talk to an attorney who specializes in personal injury (mental-mental) claims. Talk to him, give him the details, and see how he recommends you proceed. Do not supply any more details here.

  • sometimes it is not worth the trauma of legal action, it depends how severe the trauma was, what happened?
