I fixed a rental and now i’m getting sued for vandalism

I’m the owner of a professional auto body shop. We have been in business for exactly 10 years and to celebrate I decided to rent the shabbiest rental I could find, fix it and make someone’s day. My choice settled on a Mercedes C class from 2017 that has seen better days.

I collect the keys and went straight into business.
- I pulled all the dents
- I fixed all the scratches and paint chips
- I reconditioned the paint and applied ceramic coating
- I fixed all the battle scars under the front bumper
- I cleaned and reconditioned the interior

The car looked as good as new and instead of being happy, the owner is now suing me for vandalism on the basis that I removed the car’s character and natural patina. He’s also suing me for inflicting mental pain and agony on him by “vandalizing” his car.

You shouldn't have fucked with his car without asking his permission. Maybe the dents and scratches meant something to him even if it's weird to everyone else. Maybe he doesn't want to feel like he owes you something.

I wish this lawsuit culture was stopped in the USA. He is probably happy that you fixed his car and give him a reason to sue. He deserves to be greeted with physical violence. But he would of course sue. If you have his address you could always do something with that. Pay someone to give him a beating while you're at work. Just wait a year or 2 and he wont know it was you.

If you messed with my car without asking I'd be passed too. You can't just alter someone else's property without permission, even if you're doing what you would consider improvements. He has no way of verifying the quality of the work you did and for all he knows you've done a hack job and damaged the car even worse in the process

Other than emergency repairs from a breakdown - you really should have consulted with the owner 1st (you should consult the owner for emergency repairs - but most states grant you the right to do them if you cannot contact the owner).

It's not your property and you had no right to modify it without the owners consent (even if your intentions were good).

You have only yourself to blame for the lawsuit, and I suspect that you will loose in court.

You probably shouldve asked before doing it. You pretty much handed that mental case an opportunity to sue. Though I highly doubt that lawsuit will go anywhere.

Humans are an ungrateful bunch. I stopped trying to do something nice for strangers since they're unpredictable and not worth it.
