I lost my job because my boss will not allow me to come back to work

My boss is saying I am not allowed to return to work until I get a doctors note as well as a covid test. Which I have to get seperatly since the people doing the covid test will also not see any patients. So I missed my doctors visit and have 21 sick days left. I called my boss and said I resigned becuase they are not letting me return to work. I was told that its not legal to force someone to provide a doctors note unless they have been sick for 3 days straight in a row and I only took one sick day. Whats worse is they will 100% replace me if I am out of work for more than a couple of days since we are very short staffed and it kind of pisses me off since I worked for 5 straight months with this company and they told me I was about to be promoted. Can I legally sue them for not letting me come back to work?

    You need to consult a labor attorney about filing an unlawful termination lawsuit. The laws depend on your state.

    Well, I think you messed up by resigning. If you had waited for them to fire you, it might be better grounds for unlawful termination.

    Given the fact that you were the most senior employee, it doesn't make sense that your boss would fire you randomly. If you're the lead worker, how are you so sure that you would get replaced instantly?

    Either you're irrationally paranoid, you're leaving out information in your response to litelander8's question, or your boss is actually someone who would fire you over this situation. I'm not partial to the third option, though it is possible.

    Who told you about the 3-day doctors note thing? If it wasn't an attorney or a direct citation of a law code or something, I would do a bit more research. Look into your state's laws.

    Seriously, you quit your job over your boss wanting you to get a COVID test + doctor's note? I think the doctor's note thing is weird and unnecessary, but I also think that quitting your job is too.

    • Because we are short staffed and everytime someone leaves for more than two days they get replaced. The boss did this already to other workers and they were only out for a week and stated "Well we need bodys" so I gonna have to replace you. We hired a new guy and he did goos in a week and they were so impressed and new guy nearly replaced me and was being trained for things I had to work for 4 months to earn. My freind and looked it up and she did qoute a law. Shows how fickle management can be.
