If she consents to sex, at what point does it become illegal even if she says yes?
1 = sober
3 = can still walk but stumbling a lot, still knows your name
5 = almost passed out but still coherent (can't stand up but eyes still open)

Would she have sex with you sober? If she is already your gf and she wants to drunk, go for it. If she would regret it sober, don't do it.
For common human decency I'd have to put it at 3 or possibly 4. It isn't a crime to be a douchebag though so for the legal limit I'd have to say 5.

As I lightweight I can confirm just cause you seem cohearant bit are on the verge of passing out they are definitly not able to consent. Find yourself a girl like me who has rape fantasies and you'll be fine probably. Otherwise be ready for the police to show up later.

Uggg this question made me cringe really hard. This is not the right question to ask. You should always use common sense and when you know you know, but always favor on asking first.
Someone who's completely wasted can't give consent, they're not thinking straight. That should just be common sense.
Obviously anyone passed out cannot give consent.
The only way you have consent is if the other person has said so, but this obviously stops applying if the person changes their mind a short while later.
Also if you've both intiated sex and are obviously on the same page about it in which case you know.
