If she consents to sex, at what point does it become illegal even if she says yes?

1 = sober
3 = can still walk but stumbling a lot, still knows your name
5 = almost passed out but still coherent (can't stand up but eyes still open)

    Someone who's completely wasted can't give consent, they're not thinking straight. That should just be common sense.
    Obviously anyone passed out cannot give consent.
    The only way you have consent is if the other person has said so, but this obviously stops applying if the person changes their mind a short while later.
    Also if you've both intiated sex and are obviously on the same page about it in which case you know.
