Is it cruel or unusual?

Guy went to jail and the “mattress” he was given was soiled piss and god knows what else. He was sharing a 6/9 cell with two others, one of which was shitting himself on drug withdrawal. They were let out of their cramped cells twice a day

Would you consider this to be Unusual and/or Cruel?
Is it Unusual to sleep with bright fluorescent lights that don’t turn off?

Sleeping on a mattress that has a piss stain where the head goes…Unusual?

Inmate is being annoying and rude but non threatening/ The CO threatens to transfer him to the hole (Solitary Confinement) Cruel?

It’s jail it’s supposed to be a dungeon 6
Not in any circumstance should these things occur 11

    You should have a reasonably clean mattress.

    The rest is normal.

    During my overnight stay in jail (not my proudest moment), the lights were never turned off, so that part is normal. The only way to know what time it was was to pick up the phone and dial a certain button (it's been so many years now, I can't remember which). Luckily, I was given a decent enough mattress and my cell mate wasn't an issue.

    If it happens to a car thief I would say it's cruel, and unusual... not so much if it's a sex offender.

    Jail should be a terrible experience. Here in the UK prisons are not harsh enough. If the prisons were terrifying enough places, that would be a far better deterrent and should drive down crime rates.

      Actually the reverse has been shown to be true. America has some of the harshest prison condition of any first world country, yet they also have some of the highest percentage of returning prisoners. Meanwhile the countries with the best prison conditions, and the shortest sentence terms, have the lowest percentage of returning prisoners.

      With America though, the reason the conditions are that bad isn't because they're trying to punish criminals or deter them from committing further crimes and therefore to protect the public, it's because the government/corporations are trying to save money. They don't give a fuck about humane treatment or public safety, it's all about the money.

        It's also a cultural thing. In america we are a very individualist culture so prison ends up more as a punishment in of itself rather than rehabilitation. Though the grand majority of people going through the court system are repeat offenders. Sympathy dwindles when you are a repeat offender. Unless you are in a democratic state, there they let violent offenders go free and lock up small buisness owners who wanted to be open when walmart was.

    In terms of first world countries, it's a well known fact that the United States has awful prisons. Personally, I would consider this cruel. It's unfortunately often the case that things can actually be worse than this.

    Jail in America is kind of cruel and unusual but it is what it is. I was that guy in jail on drug withdrawals. And after a while I had court and they packed everyone who was going to court in this one small holding cell there was like 40 of us in this cell. And because I was having such bad withdrawals I stunk. It didnt matter how much a bathed I cant explain the smell. I smelt like I was dying. When we were in that cell some dude behind me started mouthing off in anger about how someone stinks needs to shower and how its bullshit youd not shower on court date. It was so packed only some people in the back could sit on a bench everyone else had to stand for hours. Eventually some dude in there had to take a shit and there was one toilet and everyone in that cell had to stand there beside him while he shit and stunk the place up. Over time the more ppl that went to court the less crowded this cell was because after court you were held elsewhere.

    Going to jail in withdrawals was the worst experience of my life I lost like 45lbs in a month. When I went to court I looked so different and I made eye contact with my "victim" and he looked surprised to see me looking like that I could tell.

    That's a cleaner mattress (and more comfortable) than I got in the navy.

    Suck it up. You fucked up, its apart of the punishment of jail.
